How Do I Get Started?
We understand that filing a bankruptcy is a very stressful, emotional, and difficult time. In order to allow our clients to make just one trip to our office we have outlined the items needed in order to allow our staff to assist you in the reorganization of your financial life. In order for our office to file a bankruptcy case with the court the following information is needed:
1. Completed client intake form
2. Certificate from an approved financial management course. You can go to http://onlinecounsel.cccsatl.org/b4ufile/ to complete this counseling online. Please use our firm code of 2709 so that the certificate is sent straight to our office.
3. Proof of income for the 60 days (Chapter 13)/ 90 days (Chapter 7) prior to filing the bankruptcy
4. Filing fee for the court.
Prior to consulting a bankruptcy attorney it is important to address the following issues:
- Pull a copy of your credit report to make sure you don't miss anything: there's nothing worse than filing bankruptcy and still having to pay a missed creditor afterwards.
- If you have not filed taxes in the past four years, the court will require this prior to confirming your case. Get the paperwork ready before you file.
- Make certain you understand your bank's policies about setoffs against your checking or savings accounts if you fail to pay for a credit card issued by that bank.
- If you are currently financing a car, make a copy of the declarations page of your insurance policy for your attorney.
- If you are currently purchasing your home and your homeowner's insurance in NOT included in your monthly mortgage payment, make a copy of the declarations page of your insurance policy for your attorney.

1. Please call our office at 404.885.6650 and make an appointment for a FREE consultation. We have six locations in the Metro Atlanta area. We understand that most of our client's have busy schedules and therefore can arrange a phone consultation or web consultation if you are unable to meet with an attorney in person to get a basic overview of your potential case. Once you complete the intake form you can either email or fax the form back to lsaedi@saediwellslaw.com with a requested consultation time and we will try to accomodate your schedule by reviewing your case with you either over the phont or via a web cam.
2. Complete the NEW CLIENT INTAKE FORM and bring it with you to your appointment. This form MUST be filled out completely in order for an attorney to assess your current financial situation. Although some of the questions may seem a bit odd, they are necessary in order to write your case.
3. Please bring the following items to your appointment (as applicable):
- Recent pay stubs or other proof of income (bank statements, checks, receipts)
- Declarations pages for your homeowners and automobile insurance
- Proof of your social security number. (social security card, W-2, health insurance card)
- Proof of photo ID (e.g. drivers license, military ID, passport)
- If you have filed previous cases, bring that case information with you.
4. Bring the completed client intake form and the items listed above to your appointment.

When will my case be filed?
We utilize state of the art technology which allows us file all our cases and supporting documents electronically 24 hours a day, 7 days a week.
Once you have met with an attorney, reviewed and signed your completed paperwork and paid all outstanding fees, your case will be filed electronically and mailed to you the same day.
